1. Introduction

These Terms of Service ("Terms") govern your use of PennyFetch ("the Service"), operated by PennyFetch ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.

2. The Service

PennyFetch provides automated invoice reminder emails for businesses and freelancers. We send payment reminders to your clients on your behalf according to your configured schedule.

3. Your Account

You are responsible for maintaining the security of your account. You must provide accurate information when creating your account. You must not use the Service to send unsolicited emails (spam) or harass recipients.

4. Acceptable Use

You agree to use the Service only for legitimate business invoicing. You must not use the Service to send fraudulent invoices, harass recipients, or for any unlawful purpose. We reserve the right to suspend accounts that violate these terms.

5. Billing & Subscriptions

Free accounts are subject to usage limits. Paid subscriptions are billed monthly or annually via Stripe. You may cancel at any time through your account settings. Refunds are handled on a case-by-case basis.

6. Email Sending

Emails are sent on your behalf using our email infrastructure. We do not guarantee delivery to all recipients. You are responsible for the content of your invoice reminders and for complying with applicable email regulations.

7. Statutory Interest Calculator

The statutory interest calculator is provided for informational purposes based on the Late Payment of Commercial Debts (Interest) Act 1998. It is not legal advice. You should verify calculations independently before making any claims.

8. Legal Document Generation

PennyFetch provides tools to generate Letter Before Action and Statutory Demand documents based on your invoice data. These documents are generated as templates only and do not constitute legal advice.

You are solely responsible for: (a) verifying that all information in any generated document is accurate and complete; (b) determining whether a Letter Before Action, Statutory Demand, or any other legal step is appropriate for your specific circumstances; (c) seeking independent legal advice before serving any legal document, particularly a Statutory Demand; (d) correctly serving any legal document in accordance with applicable rules and procedures.

PennyFetch does not verify whether debts are disputed, whether the correct legal threshold has been met, or whether the recipient is the correct legal entity. Incorrect use of legal documents, particularly Statutory Demands, can result in court orders, costs awards against you, and other adverse consequences. PennyFetch accepts no liability for any loss or damage arising from the use of generated legal documents.

9. Limitation of Liability

The Service is provided "as is" without warranties of any kind. We shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you have paid us in the preceding 12 months.

10. Termination

You may close your account at any time. We may suspend or terminate your account for violation of these Terms. Upon termination, your data will be deleted within 30 days.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email. Continued use of the Service after changes constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
